A question on the US inconsistency on Waterboarding & International Law and (generally) Genocide.....?

I do believe that the government bends the rules in their favor ,,I do believe that water boarding is torture ,,,I do believe that this guy is in serious trouble ,, when I hear people trying to legitimize water boarding as "not that bad" and say its not really torture because they arn't putting bamboo shoots under their fingernails or something,,, being deprived of oxygen is no laughing matter (suffering from asthma myself I have first hand knowledge of this) it's a very frightening experience and prisoners suffer this at the whim of their captors , just however much they please , I can only imagine the terror ! if water boarding isn't that bad then why are they recovering all this information that they are getting? my stance is this " Americans "don't torture period !! no little bits of torture ,,no all most torture ,,Americans don't torture prisoners at all !! and I would accuse anyone who did to be un-American
